Terms and Conditions for Holiday Bookings

 

Part I

1. Who may stay with us

a. The person who completes the booking through our online Booking System or by any other means is responsible for the booking. 

b. Bookings cannot be accepted from persons under 18 years of age. 

 

c. The person who makes the booking will be responsible for all persons included in the booking and should ensure that they are aware of these terms and conditions. 

 

d. The properties are designed for the comfort of persons shown on the website. This may not be exceeded unless agreed otherwise by prior written agreement by us. 

 

e. Only the people named on the booking may stay with us unless agreed otherwise by prior written agreement by us. 

 

f. Your booking is personal to you, and you cannot assign or transfer it to any other person unless agreed otherwise by prior written agreement by us. 

 

2. How to book 

a. Bookings can be made in the following ways: 

 

 

  • By telephone on 01248 450 801 

 

 

b. The properties are designed to accommodate no more than 1 vehicle per booking. 

 

c. A contract exists when we have issued a confirmation to you of your booking. 

 

d. Please check the confirmation details carefully to see that it reflects your wishes. Please let us know of any difference within seven days unless your holiday is to start within 14 days in which case you should inform us within 24 hours. 

 

e. We reserve the right to refuse any booking. 

 

3. The price you pay 

 

a. Our prices are inclusive of VAT.

 

b. The price will not be subject to change unless the rate of VAT changes. 

 

c. When you request your booking, you must pay a 25% Deposit of the price of your holiday or (if you are requesting to book 6 weeks or less before the start date) the full price. 

 

d. Unless you paid in full when requesting your booking, the balance of the price of your holiday must be paid at least 6 weeks before the start date. We are not required to send you a reminder. If the balance is not paid in time, then we may cancel the holiday and retain your deposit as our cancellation charge. We will confirm the cancellation to you in writing by email or letter. 

 

e. Please make sure that you book all the dates you need. We are not able to guarantee that we will be able to extend your booking.

 

f. A Security Deposit of £100 is required with every booking and must be secured 7 days prior to your arrival date, or when your booking is made if your booking is placed within the 7 days. This Security Deposit is held until your departure and the cleaning staff confirm that the accommodation has been left in an appropriate condition. Once this is confirmed, the Security Deposit will be released to you within 10 working days. 

 

g. Bookings requested in our hot tub properties are subject to a Hot Tub Security Deposit of £100 and must be secured 7 days prior to your arrival date, or when your booking is made if your booking is placed within the 7 days. This Hot Tub Security Deposit is held until your departure and the hot tub maintenance staff confirm that the hot tub has been left in an appropriate condition. Once this is confirmed, the Hot Tub Security Deposit will be released to you within 10 working days. 

 

h. Should you need to make any changes to your booking an administration fee of £20 is payable. Any changes must be notified to us in writing either by email, letter or through your online account. We will do our best to accommodate any changes you make to your booking but these will be subject to our consent and we cannot guarantee we will be able to meet your request. 

 

i. Any dogs that you intend on bringing with you should be declared at the booking request. Each dog comes at a fee of £20 per dog. Failure to declare this at the booking request may result in us cancelling your holiday. We allow a maximum of two well behaved dogs at our dog friendly properties. 

 

4. Arrivals and Departures 

 

a. Our accommodation is available for check in at 4:30pm. We may at our discretion and in limited circumstances allow for you to check in to the accommodation earlier when possible. If you anticipate that you will arrive later than 6:30pm you must contact us and let us know. Failure to do so may result in being unable to get into the accommodation.

 

b. If we have not heard from you by 12 noon on the day of after the start date of your rental period and you do not let us know that you are running late, we may treat your booking as cancelled and, in this circumstance, you will not be entitled to any refund.

 

c. You must vacate by 10am on the day of your departure otherwise an additional night will be charged. 

 

5. Changes caused by exceptional circumstances

 

a. We may make reasonable changes to our Services. Our changes may reflect changes in relevant laws, guidance and regulatory requirements or implement minor technical adjustments and improvements, for example to address a health and safety risk. 

 

b. If we make changes which mean we can only provide your holiday in a radically different way, we will give you the choice between confirming your booking, agreeing new booking dates with us or cancelling. We prefer that you postpone rather than cancel but will always allow you to cancel where the law gives you the right to do so. 

 

c. If the law prevents us from performing our obligations under these Terms & Conditions at all, for any reason which is not the responsibility of either party, we may ask you to postpone but will allow you to cancel if you prefer to do so. For these purposes, reasons which are your responsibility include any arising from your personal circumstances. Examples are ill health (except if the law prevents you from visiting of staying with us in consequence, for example because you are legally required to self-isolate) and any restrictions from your chosen career. 

 

d. If you decide to cancel where clause 5b or 5c applies, and your holiday has not started then we will refund your booking including any deposit. If your holiday has started, then we will refund any days unused. We will not charge an administration fee, and we will only deduct any costs we have already incurred which we cannot recover elsewhere (‘Direct Costs’). We will not be liable to make any further payments to you. 

 

e. We may also cancel your holiday, or any unused days, if Government guidance means that you should not visit or stay with us, even if the law still allows you to do so. If we cancel and your holiday has not started, then we will refund your booking in full including any deposit. If you holiday has started, then we will refund in full any days unused when we cancel. We will not charge an administration fee and we will not deduct any Direct Costs. 

 

6. Other cancellations 

 

a. We prefer that customers who are unable to take their holiday agree to postpone to a mutually convenient date. However, you may cancel your holiday at any time. Cancellation will be effective on the date it is received by us. 

 

b. If you cancel under clause 6a, cancellation charges are payable as follows unless you are doing so because we are in serious breach of our obligations in these Terms and Conditions. 

 

 

 

​c. If you must cancel your booking because UK Government public health measures imposed as a result of the COVID-19 pandemic mean it is unlawful to travel to or to make use of the accommodation you booked, you may choose to: 

 

  • Transfer your booking to a later date free of any administration charges, subject to availability – you will have to pay any difference in price if the cost of the new booking is higher or be reimbursed the difference if the cost of the new booking is lower. 

 

  • Obtain a refund of the amount already paid by you for the booking, less any administrative costs which we incur in processing your refund.  

 

d. If any person(s) in your party needs to cancel, this will not affect the total cost of your booking. No refunds are payable in the event that you cut short your stay. 

 

7. Insurance

 

a. We recommend that you take out travel insurance to cover you for your total stay. 

 

b. You should ensure that you take your policy documentation with you on holiday. 

 

c. It is your responsibility to make sure that any insurance cover you purchase is suitable for your needs. 

 

8. Your obligations in respect of the accommodation

 

a. You must pay the security deposit requested for your accommodation outlined in clause 3f and 3g. This security deposit must be paid either when the deposit is paid or when the full amount is due, no less than 6 weeks prior to your arrival. 

 

b. You and all members of your party agree: 

 

  • Keep the accommodation clean and tidy.

  • To leave the accommodation in a similar condition as you found it when you arrived. 

  • To behave in a way at all times while at the accommodation which does not break any law. 

  • Not to use the accommodation for any illegal or commercial purpose. 

  • Not to sublet the accommodation or any part thereof or otherwise allow anyone to stay in it who we have not previously accepted as a member of your party

  • Not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others. 

 

c. You must not allow more people than the accommodation is advertised to allow overnight, and prior consent must be obtained for visitors to attend the accommodation during your stay. You are not to hold events such as parties or celebrations at the accommodation without our advance consent. If you do any of these things, we reserve the right to refuse access into the accommodation or repossess it. If we must do this, we will treat this as you are cancelling the booking, and you will therefore not receive a refund of any money you have paid for the booking. We will also not be responsible for any costs you may incur as a result of us doing this (for example, costs of finding alternative accommodation) and we are under no obligation to find you alternative accommodation.

 

d. You must abide by these Terms & Conditions and the Park Rules which can be found in Part II of these terms. 

 

e. If our accommodation is pet friendly, this will be expressly advertised on our website. If there is no advertisement that the accommodation is pet friendly, then it is assumed that no pets will be allowed. You must declare at the point of booking that you have a pet accompanying you as this does incur additional charges (please see clause 3i). We recommend that any dog must have insurance which includes sufficient pet liability cover, and you are wholly responsible for the supervision and behaviour of your pet at all times. You must not leave your pets unattended at the accommodation at any time, this includes the garden area.  Your pets are not allowed on any beds or furniture. You must not use the hot tub, shower or washing facilities of the accommodation to clean your pet. There is a specific outside shower facility for this purpose (please ask a member of staff to point this out to you).  Our properties are located on our caravan parks and therefore, you must adhere to the Park Rules whilst your pets are on park. 

 

f. All our properties are a no smoking area, this includes e-cigarettes. You are permitted to smoke outside the accommodation, but it is your responsibility to ensure all cigarettes are safely disposed of in the external bins provided. 

 

9. Changing the Park Rules 

 

a. It may be necessary or desirable to change the Park Rules from time to time, including for reasons of health and safety, the efficient running of the Park, environmental issues, local authority requirements, and/or changes in law or regulations or in the interpretation of law and regulations imposed upon us, in which case we will notify you in writing using your contact details at the address of the Booking Form. 

 

b. Any changes made to the Park Rules after we accept your booking may affect you because you will be required to comply with the changed Park Rules but will not affect anything else to which you are entitled under these booking Terms & Conditions. 

 

10. Keys 

 

a. We hold a key to all the accommodation we own on the Park 

 

b. If you are staying in our accommodation, we may use the key for any purpose authorised by you, for example if you ask us to give access to an authorised visitor. We may require you to confirm your authority in writing, 

 

c. We may also use the key in an emergency, such as an immediate concern for the health and safety of any person, to carry out urgent repairs or preventative work, or to check and secure the accommodation if it appears to be insecure. 

 

11. Complaints

 

a. We are confident you will be happy with our service. If you have any complaint, we encourage you to discuss it with us as soon as possible as this gives us the best chance of resolving it with you. If you remain unhappy, please contact us again within 28 days of your departure and we will try to help.

12. Personal Data 

 

a. Any personal data you give to us will be processed in accordance with the law and our privacy policy. Please see our Privacy Notice on our website which explains how we will process your personal data. 

 

13. Interpretation 

 

  • “Park Rules” means the rules of conduct and practice issued by us from time to time and applicable to the Park. The Park Rules which currently apply to your booking at in Part II of these terms and conditions. 

 

  • “You/your” means the person making the booking and all members of their party excluding children under 18. Where there is more than one person, each is fully responsible for the obligations in these Terms & Conditions. 

 

  • “Services” means the services which we have promised to make available without a separate charge to you, for example any utilities to your accommodation, Service for which we make a separate charge are provided under separate agreements and not these Terms & Conditions. 

 

  • “We/us/our” means the accommodation and park owner and/or manager. 

 

Part II 

 

Park Rules

 

These Park Rules are in place for the good management of the park and the benefit of all who use it. These rules form part of the Terms & Conditions. 

 

The Park Rules do not affect anything to which you are entitled under the terms of the Terms & Conditions above. 

 

You must make sure that anyone using the accommodation is aware of the Park Rules. 

 

The rules set out below are the Park Rules referred to in your Terms & Conditions. You are reminded that breach of these rules is a breach of your obligations under the Terms & Conditions. 

 

Safety 

  • You must use the park safely and should not cause danger to others

  • You must obey all health and safety notices displayed on the park and act on the instruction of park staff in matters of health and safety. 

 

Security 

  • You are solely responsible for securing the accommodation during your stay. 

 

Permitted number of occupiers 

  • Your accommodation may not be used for sleeping a number of persons greater than the ‘maximum sleeping capacity’ stipulated on our website.

 

Visitors to the park 

  • The Park is private property and only people lawfully staying with your permission have permission to enter the park. 

  • We do not permit traders, contractors, or salesmen access to the park except with our prior consent. 

  • It is your responsibility to ensure that your visitors and all occupiers of your accommodation adhere to the Park Rules. 

Ejection on grounds of behaviour 

  • In the event of persistent or serious misconduct by you, a member of your family, your occupiers’ visitors or guests, we will follow any relevant cancellation procedures in our terms with you. We do not have to follow any formal procedure to eject other visitors. 

 

Utilities installations 

  • If you experience any problem with the park’s electrical, gas or water system, you should contact us. You must not attempt to work on any part of the park’s electrical, gas or water system yourself.

 

Drainage system 

  • You must not introduce any foreign items into the drainage system, including cleaning cloths, babies’ nappies, sanitary towels, condoms, cooking fat, engine oil, grease or paint, or any chemical that may have an adverse effect on our drainage system. 

 

Tents

  • You must not erect any tent on the park. 

 

Facilities 

  • The usual opening and closing dates of our facilities are provided on our signage. However, the times of opening may be subject to change depending on seasonal fluctuations or unforeseen circumstances. 

 

Trees and Shrubs 

  • You must not cut any trees or hedges at the park. If you find any tree or hedge a nuisance or unsatisfactory, please take the matter up with us. 

  • You must not plant any tree or shrub without our prior written consent.

  • You must not climb any tree. 

  • You must not tie anything to any tree or shrub without our agreement in writing (which we will not withhold unreasonable where the tie is a means of support for any tree or shrub which you have planted with our agreement)

 

Digging 

  • You must not dig any hole at the park.

 

Smoking 

  • It is illegal to smoke or use e-cigarettes inside enclosed public buildings. 

 

Washing 

  • You may only use washing lines of the rotary type or windowsill type only and must be removed and store them out of sight immediately after use. 

  • You must site washing lines to avoid inconvenience of other caravan owners and park operations. 

 

Refuse

  • You must not deposit refuse outside. You must use the refuse bins provided.

  • The refuse bins provided are for general household waste only. Do not dispose of any electrical items, or other items that are not capable of being disposed of as general household waste.

  • Any garden waste should be disposed of in the green garden waste bins provided. 

 

Vehicles, driving and parking 

 

Vehicles

  • You must insure all vehicles you use on the park as for use on the public road. 

  • You must insure all accessories and items towed by vehicles (such as towed boats and jet skis) as for use on the public road. 

  • You must not keep disused or unroadworthy vehicles anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned. 

  • You must not carry out the following works or repairs on the park: 

    • Major vehicle repairs such as dismantling of part(s) of the engine

    • Works which involve the removal of oil or other fuels

  • Quad bikes, trial bikes and powered scooters are not permitted on the park. 

 

Driving 

  • We permit cars onto the park for the purposes of access to the accommodation only. Accordingly, save to the extent that you may need to do so because of a disability, you must not drive cars around the park for other purposes such as visiting other locations on the park. 

  • Driving on the park is restricted to the park roads. 

  • You must drive all vehicle on the park carefully and within the displayed speed limit. 

  • You must hold a full current driving licence to drive any vehicle on the park. 

  • You are not permitted to give anyone driving lessons at the park and we do not permit learner drivers to drive on the park. 

  • There is a speed limit on all park roads of 5mph, which must be adhered to. 

  • We allow a maximum of 2 motorised vehicles to be parked alongside each pitch. 

  • We have an allocated electric charging point on our Bryn Awel Park. Car charging from your property is not permitted.  

 

Parking

  • Your accommodation has allocated parking bay for one vehicle. Any additional vehicle in attendance will have to find alternative parking. If there is alternative parking available on the park, we will notify you of this. However, we cannot guarantee parking availability for any additional vehicles. 

  • Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including: 

    • Light commercial or light goods vehicles as described in the vehicle taxation legislation and; 

    • Vehicles intended for domestic use but derived from or adapted from such a commercial vehicle. 

  • You must park, and move off, with great care for pedestrians and particularly for children. 

 

Behaviour 

  • You should respect the privacy of other users of the park and keep noise to a minimum between the hours of 10pm and midnight with absolute quiet between the hours of midnight and 8am. 

  • You must keep away from any vacant pitches. 

  • You must not use a drone, powered model aircraft or any other powered flying object on the park. 

  • You must not use any Chinese lanterns, fireworks or similar. 

  • You may only consume alcoholic drinks within the boundaries of your accommodation.

  • You must finish any party by midnight. 

  • You may not ride bicycles, scooters or similar so as to cause a nuisance or undue noise.

  • You must not use the park’s water supply to fill paddling pools, lazy spas, hot tub, or any other water feature. 

  • Lazy spas and hot tubs not provided for by the park are not permitted. If you have booked an accommodation with a hot tub, you must adhere to the Hot Tub terms and conditions which will be sent out to your separately upon booking. 

 

Pets 

  • Dogs must be kept on a lead at all times on the park and you must clean up if the animal defecates anywhere on the park, including your gardens. 

  • Any pet or animal you bring must be supervised by and under the control of you, or of a responsible adult in your party, at all times. This means you may not leave any pet or animal unsupervised in a caravan, tent or other holiday accommodation or anywhere else on the park at any time, apart from small pets which live in a cage, aquarium or similar and which may be left safely for short periods. Nor may you leave any pet or animal under the supervision of any person aged under 18. These rules apply even if the pet or animal knows the park well and you believe them to be well-behaved 

  • If you do not supervise and control any pet or animal, we are likely to ask you to remove it from the park straight away. Depending on the circumstances, you may not be allowed to bring it back, or may only be allowed to do so with our written permission, which we would not withhold once our reasonable concerns have been addressed. This is because we cannot allow the safety of others to be put at risk. 

  • If you see another pet or animal anywhere on the park which does not appear to be supervised by and under the control of a responsible adult, or whose behaviour gives a cause for concern, please tell us straight away. 

  • You must not allow your pets and animals to cause any nuisance, undue noise or disturbance. 

  • Nothing in these Park Rules prevents you or any member of your party from bringing an assistance dog to the park, or from using the dog exactly as at home, if this is required to support a disability and Assistance Dogs UK or any successor body has issued an Identification Book or other appropriate evidence.

 

Recreation 

 

  • You may only play ball and other games in the areas set aside for recreation. 

  • You may not fly kites on the park

 

Mail

  • You may not use the park address for postal deliveries unless permission has been sought. 

 

Children

  • Children must be supervised whilst on the park and are the responsibility of their parent or guardian during their stay. 

  • Never allow children to play near or in the streams/rivers, as there areas of deep water.

  • Children must not play on the play area before 8am or after 10pm. 

  • Children under the age of 16 should not be left unsupervised in the Caravan or on the park. 

  • An adult must accompany small children to the toilets. 

  • Children must not play in the games room before 10am or after 10pm. The facility will be locked outside of these hours. 

  • Children are to be supervised so that they are not a nuisance or a danger to themselves or others.  

 

Fire precautions 

  • You must not store fuels or combustible materials other than removable containers on the park. 

  • There is to be no open fires on the park, with the exception of a chiminea. If using a chiminea the following rules must be adhered to:

    • Only wood must be used in the chiminea.

    • No wood is to be obtained from any of the grounds on the park for use in the chiminea.

    • The chiminea whilst burning must be supervised at all times. It is your responsibility to ensure the fire in the chiminea is controlled and put out safely.

    • Smoke from the chiminea must not cause nuisance to any neighbours and you must be mindful of where the chiminea is positioned so as to avoid any nuisance. 

    • We may ask you to stop using your chiminea on the park should you not adhere to any of the rules above. 

  • Barbeques are permitted on the park as long as they are raised off the ground and does not cause any damage to the parks grass or slabs. It is your responsibility to ensure that the barbeque is disposed/switched off/made safe following use. 

  • You must ensure that all occupants of your accommodation are familiar with the location of the Fire Points and the contents of the Fire Notices displayed at each point. 

 

Lost Property 

  • For any lost property, place contact the Park Reception as soon as possible as any lost property will be disposed of after one month. 

 

Wi-fi

  • Our Wi-fi is very restricted due to our rural location and is not for streaming. The service may not be the same as you are used to at home.
